Deaf Conroe man indicted on capital murder<\/strong><\/p>\n

While her deaf client has been indicted on a charge of capital murder in the
\nstabbing death of his estranged wife, a Houston attorney said she doesn\u2019t
\nbelieve that charge should stick because he \u201cdidn\u2019t mean to kill her.\u201d<\/p>\n

Willis police arrested Earl Handy Jr., 39, of Conroe, Jan. 16 for allegedly
\nfatally stabbing Donna Allen Handy, 34, in her home. He also is charged with
\naggravated assault with a deadly weapon after allegedly injuring Handy\u2019s
\nboyfriend, Joseph Taylor, of Conroe.<\/p>\n

Police previously said Handy waited outside his wife\u2019s home for the
\nopportunity to confront her and Taylor. When Taylor opened the door to the
\nsingle-wide mobile home in the 13000 block of Aspen Way Court in the Pin Oak
\nsubdivision shortly before 8 a.m., Handy allegedly stabbed him several times
\nin the upper body.<\/p>\n

Police arrived to find Donna Handy stabbed in the chest, and she was later
\npronounced dead at Conroe Regional Medical Center. Earl Handy was found in
\nthe other end of the home, and police used their Taser stun guns to subdue
\nhim when he began stabbing himself, Willis Police Detective Alton Nelson
\npreviously said.<\/p>\n

Handy is still in the Montgomery County Jail with no bond amount set,
\naccording to jail information.<\/p>\n

His indictment states Handy intentionally caused the death of Donna Allen by
\nstabbing her with a knife while committing or attempting to commit of
\nburglary.<\/p>\n

A person commits capital murder \u201cif the person intentionally commits the
\nmurder in the course of committing or attempting to commit kidnapping,
\nburglary, robbery, aggravated sexual assault, arson, obstruction or
\nretaliation, or terroristic threat\u201d under the Texas Penal Code.<\/p>\n

The penalty for capital murder includes life in prison, life in prison
\nwithout parole or death. The Montgomery County District Attorney\u2019s Office
\nhas not made a decision on whether to seek the death penalty, Chief
\nAssistant District Attorney Phil Grant said.<\/p>\n

\u201cThe decision on the death penalty will be made by (DA) Brett (Ligon) at
\nsome point,\u201d he said.<\/p>\n

But \u201cI think it would be a true tragedy if Montgomery County decided to seek
\nthe death penalty,\u201d said Houston attorney Katherine Scardino, appointed to
\nrepresent Handy. \u201cI don\u2019t think it\u2019s capital murder in the first place.\u201d<\/p>\n

Handy\u2019s deafness was caused by a high fever when he was 16 months old,
\nScardino said, and he\u2019s struggled his entire life to support himself and his
\nfamily. He uses sign language but can\u2019t read lips.<\/p>\n

Two sign-language interpreters have been appointed to Handy by the 9th state
\nDistrict Court of Judge Fred Edwards, according to records from the
\nMontgomery County District Clerk\u2019s Office.<\/p>\n

The facts of the case are \u201cso very sad and egregious in the sense that the
\nwoman died but he didn\u2019t mean to kill her,\u201d said Scardino, who won an
\nacquittal in a high-profile Harris County capital murder case in the late
\n1990s. \u201cHe was fighting the boyfriend who he saw inside the house he bought
\nfor them (Handy and his wife). It\u2019s a really, really sad story.\u201d<\/p>\n

Grant deferred comment on any specifics of Handy\u2019s case.<\/p>\n

\u201cWhile it is always tempting to try these types of cases in the press,
\nethical rules demand that we limit our discussion of the facts of pending
\ncriminal cases,\u201d he stated in an e-mail. \u201cWe look forward to presenting
\nthose facts to a jury of Montgomery County residents at the appropriate
\ntime.\u201d<\/p>\n

Handy has no prior arrests, Scardino said, and Public Data lists no previous
\ncriminal history for him.<\/p>\n

\u201cIt\u2019s like the country song, \u2018That\u2019s my house and that\u2019s my car, that\u2019s my
\ndog in the back yard,\u2019\u201d Scardino said. \u201cIt\u2019s his property, it\u2019s his wife. He
\ndidn\u2019t take anything.<\/p>\n

\u201cI don\u2019t understand why the state is calling it a capital murder.\u201d<\/p>\n
