{"id":11228,"date":"2010-07-28T02:48:07","date_gmt":"2010-07-28T07:48:07","guid":{"rendered":"http:\/\/deafnetwork.com\/wordpress\/?p=11228"},"modified":"2010-07-28T04:26:04","modified_gmt":"2010-07-28T09:26:04","slug":"increasing-federal-employment-of-individuals-with-disabilities","status":"publish","type":"post","link":"https:\/\/deafnetwork.com\/wordpress\/blog\/2010\/07\/28\/increasing-federal-employment-of-individuals-with-disabilities\/","title":{"rendered":"Increasing Federal Employment of Individuals with Disabilities"},"content":{"rendered":"<p><strong>President Barack Obama Issues Executive Order \u2014 Increasing Federal<br \/>\nEmployment of Individuals with Disabilities<\/strong><\/p>\n<p>The White House<br \/>\nOffice of the Press Secretary<br \/>\nFor Immediate Release<br \/>\nJuly 26, 2010<\/p>\n<p>Executive Order&#8211; Increasing Federal Employment of Individuals with<br \/>\nDisabilities<\/p>\n<p>By the authority vested in me as President by the Constitution and the laws<br \/>\nof the United States of America, and in order to establish the Federal<br \/>\nGovernment as a model employer of individuals with disabilities, it is<br \/>\nhereby ordered as follows:<\/p>\n<p>Section 1.  Policy.  Approximately 54 million Americans are living with a<br \/>\ndisability.  The Federal Government has an important interest in reducing<br \/>\ndiscrimination against Americans living with a disability, in eliminating<br \/>\nthe stigma associated with disability, and in encouraging Americans with<br \/>\ndisabilities to seek employment in the Federal workforce.  Yet Americans<br \/>\nwith disabilities have an employment rate far lower than that of Americans<br \/>\nwithout disabilities, and they are underrepresented in the Federal<br \/>\nworkforce.  Individuals with disabilities currently represent just over 5<br \/>\npercent of the nearly 2.5 million people in the Federal workforce, and<br \/>\nindividuals with targeted disabilities (as defined below) currently<br \/>\nrepresent less than 1 percent of that workforce.<\/p>\n<p>On July 26, 2000, in the final year of his administration, President Clinton<br \/>\nsigned Executive Order 13163, calling for an additional 100,000 individuals<br \/>\nwith disabilities to be employed by the Federal Government over 5 years.<br \/>\nYet few steps were taken to implement that Executive Order in subsequent<br \/>\nyears.<\/p>\n<p>As the Nation&#8217;s largest employer, the Federal Government must become a model<br \/>\nfor the employment of individuals with disabilities.  Executive departments<br \/>\nand agencies (agencies) must improve their efforts to employ workers with<br \/>\ndisabilities through increased recruitment, hiring, and retention of these<br \/>\nindividuals.  My Administration is committed to increasing the number of<br \/>\nindividuals with disabilities in the Federal workforce through compliance<br \/>\nwith Executive Order 13163 and achievement of the goals set forth therein<br \/>\nover 5 years, including specific goals for hiring individuals with targeted<br \/>\ndisabilities.<\/p>\n<p>Sec. 2.  Recruitment and Hiring of Individuals with Disabilities.  (a)<br \/>\nWithin 60 days of the date of this order, the Director of the Office of<br \/>\nPersonnel Management, in consultation with the Secretary of Labor, the Chair<br \/>\nof the Equal Employment Opportunity Commission, and the Director of the<br \/>\nOffice of Management and Budget, shall design model recruitment and hiring<br \/>\nstrategies for agencies seeking to increase their employment of people with<br \/>\ndisabilities and develop mandatory training programs for both human<br \/>\nresources personnel and hiring managers on the employment of individuals<br \/>\nwith disabilities.<\/p>\n<p>(b)  Within 120 days of the date the Office of Personnel Management sets<br \/>\nforth strategies and programs required under subsection (a), each agency<br \/>\nshall develop an agency specific plan for promoting employment opportunities<br \/>\nfor individuals with disabilities.  The plan shall be developed in<br \/>\nconsultation with and, as appropriate, subject to approval by the Director<br \/>\nof the Office of Personnel Management and the Director of the Office of<br \/>\nManagement and Budget, and shall, consistent with law, include performance<br \/>\ntargets and numerical goals for employment of individuals with disabilities<br \/>\nand sub goals for employment of individuals with targeted disabilities.<br \/>\n(c)  Each agency shall designate a senior-level agency official to be<br \/>\naccountable for enhancing employment opportunities for individuals with<br \/>\ndisabilities and individuals with targeted disabilities within the agency,<br \/>\nconsistent with law, and for meeting the goals of this order.  This<br \/>\nofficial, among other things, shall be accountable for developing and<br \/>\nimplementing the agency&#8217;s plan under subsection (b), creating recruitment<br \/>\nand training programs for employment of individuals with disabilities and<br \/>\ntargeted disabilities, and coordinating employment counseling to help match<br \/>\nthe career aspirations of individuals with disabilities to the needs of the<br \/>\nagency.<br \/>\n(d)  In implementing their plans, agencies, to the extent permitted by law,<br \/>\nshall increase utilization of the Federal Government&#8217;s Schedule A excepted<br \/>\nservice hiring authority for persons with disabilities and increase<br \/>\nparticipation of individuals with disabilities in internships, fellowships,<br \/>\nand training and mentoring programs.<\/p>\n<p>(e)  The Office of Personnel Management shall assist agencies with the<br \/>\nimplementation of their plans.  The Director of the Office of Personnel<br \/>\nManagement, in consultation with the Director of the Office of Management<br \/>\nand Budget, shall implement a system for reporting regularly to the<br \/>\nPresident, the heads of agencies, and the public on agencies&#8217; progress in<br \/>\nimplementing their plans and the objectives of this order.  The Office of<br \/>\nPersonnel Management, to the extent permitted by law, shall compile and post<br \/>\non its website Government wide statistics on the hiring of individuals with<br \/>\ndisabilities.<\/p>\n<p>Sec. 3.  Increasing Agencies&#8217; Retention and Return to Work of Individuals<br \/>\nwith Disabilities.  (a)  The Director of the Office of Personnel Management,<br \/>\nin consultation with the Secretary of Labor and the Chair of the Equal<br \/>\nEmployment Opportunity Commission, shall identify and assist agencies in<br \/>\nimplementing strategies for retaining Federal workers with disabilities in<br \/>\nFederal employment including, but not limited to, training, the use of<br \/>\ncentralized funds to provide reasonable accommodations, increasing access to<br \/>\nappropriate accessible technologies, and ensuring the accessibility of<br \/>\nphysical and virtual workspaces.<\/p>\n<p>(b)  Agencies shall make special efforts, to the extent permitted by law, to<br \/>\nensure the retention of those who are injured on the job.  Agencies shall<br \/>\nwork to improve, expand, and increase successful return to work outcomes for<br \/>\nthose of their employees who sustain work-related injuries and illnesses, as<br \/>\ndefined under the Federal Employees&#8217; Compensation Act (FECA), by increasing<br \/>\nthe availability of job accommodations and light or limited duty jobs,<br \/>\nremoving disincentives for FECA claimants to return to work, and taking<br \/>\nother appropriate measures.  The Secretary of Labor, in consultation with<br \/>\nthe Director of the Office of Personnel Management, shall pursue innovative<br \/>\nre employment strategies and develop policies, procedures, and structures<br \/>\nthat foster improved return to work outcomes, including by pursuing overall<br \/>\nreform of the FECA system.  The Secretary of Labor shall also propose<br \/>\nspecific outcome measures and targets by which each agency&#8217;s progress in<br \/>\ncarrying out return to work and FECA claims processing efforts can be<br \/>\nassessed.<br \/>\nSec. 4.  Definitions.  (a)  &#8220;Disability&#8221; shall be defined as set forth in<br \/>\nthe ADA Amendments Act of 2008.<\/p>\n<p>(b)  &#8220;Targeted disability&#8221; shall be defined as set forth on the form for<br \/>\nself identification of disability, Standard Form 256 (SF 256), issued by the<br \/>\nOffice of Personnel Management, or any replacements, updates, or revisions<br \/>\nthereto.<\/p>\n<p>(c)  Not less than 1 year after the date of this order and in consultation<br \/>\nwith the Equal Employment Opportunity Commission, the Department of Labor,<br \/>\nand the Office of Management and Budget, the Office of Personnel Management<br \/>\nshall review the effectiveness of the definition of targeted disability set<br \/>\nforth in SF 256 and replace, update, or revise it as appropriate.<br \/>\nSec. 5.  General Provisions.
