{"id":12691,"date":"2010-12-24T15:56:07","date_gmt":"2010-12-24T20:56:07","guid":{"rendered":"http:\/\/deafnetwork.com\/wordpress\/?p=12691"},"modified":"2010-12-27T17:35:40","modified_gmt":"2010-12-27T22:35:40","slug":"apd-detective-disputes-chronicle-story","status":"publish","type":"post","link":"https:\/\/deafnetwork.com\/wordpress\/blog\/2010\/12\/24\/apd-detective-disputes-chronicle-story\/","title":{"rendered":"APD Detective Disputes &#8216;Chronicle&#8217; Story"},"content":{"rendered":"<p><strong>APD Detective Disputes &#8216;Chronicle&#8217; Story<\/strong><\/p>\n<p>BY JORDAN SMITH AND MICHAEL KING<\/p>\n<p>According to Austin Police Department Detective Daniel Arizpe, the<br \/>\nChronicle&#8217;s description of the June 30, 2000, incident at the Catfish<br \/>\nParlour \u2013 in our Dec. 3 story &#8220;Tone Deaf,&#8221; about communication problems<br \/>\nbetween APD and deaf residents \u2013 was just plain wrong. &#8220;I did absolutely<br \/>\nnothing wrong,&#8221; he told us last week during a meeting at APD headquarters.<\/p>\n<p>The brief passage in the story that concerns Arizpe&#8217;s actions that day reads<br \/>\nas follows: &#8220;When APD Officer Daniel Arizpe arrived, he did not provide an<br \/>\ninterpreter even after Joan repeatedly asked for one; instead, Arizpe used<br \/>\nonly his voice to communicate that he intended to arrest Richard. Richard<br \/>\ndidn&#8217;t know what was happening \u2013 or even that Arizpe was a cop \u2013 and when<br \/>\nArizpe tried to arrest him, he bit the officer&#8217;s arm.&#8221; (Arizpe is not<br \/>\notherwise mentioned.)<\/p>\n<p>Shortly after the story ran, we got a call from APD&#8217;s public information<br \/>\noffice telling us that Arizpe felt he was incorrectly and unfairly portrayed<br \/>\nand wanted a meeting with us.<\/p>\n<p>At that Dec. 16 meeting, Arizpe said that we erred in reporting that he<br \/>\nfailed to call for an interpreter to communicate with Richard Bell (who is<br \/>\ndeaf and blind) and his wife, Joan (who is deaf), after the couple allegedly<br \/>\ngot into an altercation with the restaurant manager, an incident that<br \/>\nstarted after the couple had requested a braille menu. Arizpe said that he<br \/>\ndid in fact call for an interpreter \u2013 three times, he says \u2013 before<br \/>\narresting Richard and taking him to jail. Arizpe doesn&#8217;t recall how long he<br \/>\nwaited for an interpreter to arrive at the scene but estimates it was about<br \/>\n30 minutes. Arizpe said he also tried communicating with Richard by writing<br \/>\nnotes; he said Richard had already been trying to communicate via writing<br \/>\nand that he believed Richard could read the notes that he wrote but refused<br \/>\nto do so. Further, Arizpe said that an interpreter did take over once the<br \/>\ncouple was at the jail.<\/p>\n<p>Arizpe said that no charges were filed because he was &#8220;trying to be nice,&#8221;<br \/>\neven though Richard had bitten him on the arm. The manager at the Catfish<br \/>\nParlour, who told Arizpe that Richard had struck him across the head with<br \/>\nthe white cane he uses as a mobility tool, apparently did not pursue assault<br \/>\ncharges either. (In fact, no charges of any kind were ever filed.)<\/p>\n<p>Our summary of the Catfish Parlour episode was based on the court documents<br \/>\nof record concerning the federal civil rights lawsuit that was filed on<br \/>\nbehalf of the Bells, under the terms of the Americans With Disability Act,<br \/>\nby the Texas Civil Rights Project.
