{"id":12881,"date":"2011-01-12T11:01:25","date_gmt":"2011-01-12T16:01:25","guid":{"rendered":"http:\/\/deafnetwork.com\/wordpress\/?p=12881"},"modified":"2011-01-13T13:20:55","modified_gmt":"2011-01-13T18:20:55","slug":"nad-files-suit-on-behalf-of-deaf-boy-scout","status":"publish","type":"post","link":"https:\/\/deafnetwork.com\/wordpress\/blog\/2011\/01\/12\/nad-files-suit-on-behalf-of-deaf-boy-scout\/","title":{"rendered":"NAD Files Suit on Behalf of Deaf Boy Scout"},"content":{"rendered":"<p><strong>NAD Files Suit on Behalf of Deaf Boy Scout<\/strong><\/p>\n<p>The National Association of the Deaf (NAD) and the law firm of Chason,<br \/>\nRosner, Leary &amp; Marshall L.L.C., filed a complaint in federal court against<br \/>\nthe National Capital Area Council, Boy Scouts of America (NCAC), alleging<br \/>\nthat the NCAC has failed to ensure effective communication for one of its<br \/>\ntroop members, Wolfgang Staley, who is deaf. The complaint was filed in the<br \/>\nUnited States District Court for the Southern District of Maryland.<\/p>\n<p>Despite requests by the boy\u2019s mother, Cindy Officer, the NCAC has refused to<br \/>\nprovide ASL interpreters at troop meetings and at their monthly outgoings.<br \/>\nThe NCAC troop meetings and monthly outgoings include immense amount of<br \/>\ninformation, including safety information, which cannot be effectively<br \/>\ncommunicated to Wolfgang other than through an ASL interpreter. As such, he<br \/>\nis deprived of full participation in various Boy Scouts activities and<br \/>\nunable to reap benefits that other boys of the NCAC enjoy, whether it is an<br \/>\nopportunity to create intimate friendships with fellow troop members or<br \/>\ndevelop leadership skills during a weekend outgoing.<\/p>\n<p>\u201cThe NCAC refusal to provide ASL interpreters violates Title III of the<br \/>\nAmericans with Disabilities Act (ADA) and section 504 of the Rehabilitation<br \/>\nAct. Their actions discriminate against Wolfgang Staley solely based on his<br \/>\ndeafness, and against Cindy Officer based on her association with Wolfgang<br \/>\nStaley,\u201d said Debra Patkin, NAD Law and Advocacy staff attorney. \u201cThe NAD<br \/>\nrequests that the U.S. District Court declare that the NCAC refusal to<br \/>\nprovide interpreters at its events is a violation of the ADA and the<br \/>\nRehabilitation Act. The filing further requests that the court award money<br \/>\ndamages to the plaintiffs.\u201d<\/p>\n<p>\u201cThe intent of the ADA was to promote and ensure inclusion of individuals<br \/>\nwith disabilities in daily activities.
