{"id":17907,"date":"2012-03-05T22:01:48","date_gmt":"2012-03-06T03:01:48","guid":{"rendered":"http:\/\/deafnetwork.com\/wordpress\/?p=17907"},"modified":"2012-03-05T22:57:52","modified_gmt":"2012-03-06T03:57:52","slug":"nad-files-comments-on-copyright-exemption-for-captions","status":"publish","type":"post","link":"https:\/\/deafnetwork.com\/wordpress\/blog\/2012\/03\/05\/nad-files-comments-on-copyright-exemption-for-captions\/","title":{"rendered":"NAD Files Comments on Copyright Exemption for Captions"},"content":{"rendered":"<p><strong>NAD Files Comments on Copyright Exemption for Captions<\/strong><\/p>\n<p>By Shane.Feldman<\/p>\n<p>Friday 03\/02\/2012<\/p>\n<p>On February 10, 2012, the National Association of the Deaf (NAD) took<br \/>\nthe lead, and was joined by several other consumer groups, in<br \/>\nsubmitting comments in support of a petition filed by<br \/>\nTelecommunications for the Deaf and Hard of Hearing, Inc., Gallaudet<br \/>\nUniversity, and Participatory Culture Foundation requesting an<br \/>\nexemption for certain classes of work from the anti-circumvention<br \/>\nprovisions of the Digital Millennium Copyright Act (DMCA). Two of these<br \/>\nexemption requests relate to closed captioning \u2013 one for IP based media<br \/>\nand the other for fixed-disc based media. These exemptions will allow<br \/>\nthird parties to add or improve closed captioning on video programs<br \/>\nwithout having to get permission from the copyright owner.<\/p>\n<p>As many of our members know, there is a vast amount of video programs<br \/>\nthat are neither captioned nor required to be captioned. For instance,<br \/>\nDVDs are generally not required to be captioned, and there also are<br \/>\nlarge gaps in the new rules requiring captioning for IP based video<br \/>\nprograms. While we will not rest in our advocacy efforts to expand the<br \/>\ncoverage of captioning laws, the NAD wants to make it possible for<br \/>\nthird parties to voluntarily add or improve captions any video<br \/>\nprogram.<\/p>\n<p>We have learned that some schools wanted to add captions to videos<br \/>\nshown in class and were not able to do so due to copyright concerns. We<br \/>\nalso have seen volunteer efforts such as <a href=\"http:\/\/www.universalsubtitles.org\" target=\"_blank\">http:\/\/www.universalsubtitles.org<\/a><br \/>\nwhich add captions to permissible online videos. Additionally, these<br \/>\nexemptions will allow third parties such as volunteers or even video<br \/>\nprogram distributors to improve the quality of captions.
