{"id":19597,"date":"2012-08-13T02:46:24","date_gmt":"2012-08-13T07:46:24","guid":{"rendered":"http:\/\/deafnetwork.com\/wordpress\/?p=19597"},"modified":"2012-08-13T03:45:19","modified_gmt":"2012-08-13T08:45:19","slug":"hearing-impaired-man-says-constables-failed-to-provide-interpreter","status":"publish","type":"post","link":"https:\/\/deafnetwork.com\/wordpress\/blog\/2012\/08\/13\/hearing-impaired-man-says-constables-failed-to-provide-interpreter\/","title":{"rendered":"Hearing impaired man says constables failed to provide interpreter"},"content":{"rendered":"<p><strong>Hearing impaired man says constables failed to provide interpreter<\/strong><\/p>\n<p>8\/9\/2012<\/p>\n<p>By John Suayan, Galveston Bureau<\/p>\n<p>HOUSTON &#8211; A Spring man who is hearing impaired has filed suit against<br \/>\nthe Harris County District Attorney&#8217;s Office and the Harris County<br \/>\nPrecinct 4 Constable&#8217;s Office for failing to provide him with an<br \/>\ninterpreter.<\/p>\n<p>Court papers filed July 20 in Houston federal court claim a neighbor&#8217;s<br \/>\ndog attacked<\/p>\n<p>Andy Scofield filed suit in federal court in Houston on July 20. The<br \/>\nsuit states Scofield&#8217;s own dog and family were attacked by a neighbor&#8217;s<br \/>\ndog on May 5.<\/p>\n<p>When Scofield tried to communicate with the neighbor through sign<br \/>\nlanguage, he alleges he was punched in the face.<\/p>\n<p>The plaintiff was not able to give his account of the events afterwards<br \/>\nbecause he was not given assistance for his disability, the suit<br \/>\nstates.<\/p>\n<p>Scofield claims he asked first responders and police for an<br \/>\ninterpreter, but was not provided one.<\/p>\n<p>He states his teenage son &#8220;was taken away without (his) knowledge or<br \/>\nconsent.&#8221;<\/p>\n<p>&#8220;The son was a mere thirteen years old but was essentially asked to<br \/>\nprovide his own deaf father&#8217;s position and explanation of the<br \/>\nincident,&#8221; the original petition says.<\/p>\n<p>&#8220;It is critical to note that the Plaintiff&#8217;s son is also hard of<br \/>\nhearing, which compounded the problem.&#8221;<\/p>\n<p>According to the suit, law enforcement &#8220;refused to take statements from<br \/>\nthe plaintiff and seemingly made a determination that the two men<br \/>\nengaged in mutual combat, without examining or investigating Scofield&#8217;s<br \/>\nnarrative.&#8221;<\/p>\n<p>&#8220;A statement was taken from (Mr.) Provost, and because he was hearing,<br \/>\nhis statement was given full credibility and reliability, without<br \/>\ndetermining the veracity thereof,&#8221; the suit says.<\/p>\n<p>The plaintiff adds subsequent efforts to get the district attorney&#8217;s<br \/>\noffice to secure an interpreter were unsuccessful.<\/p>\n<p>A request to prosecute the neighbor was also denied.<\/p>\n<p>The respondents are blamed for keeping Scofield from taking part in<br \/>\npolice services, &#8220;namely in not being able to issue a police report on<br \/>\na violent crime perpetrated upon him.&#8221;<\/p>\n<p>Consequently, the plaintiff seeks unspecified monetary damages and a<br \/>\njury trial.<\/p>\n<p>He is represented by attorney Deborah L.
