{"id":24720,"date":"2013-09-18T01:44:13","date_gmt":"2013-09-18T06:44:13","guid":{"rendered":"http:\/\/deafnetwork.com\/wordpress\/?p=24720"},"modified":"2013-09-18T01:44:13","modified_gmt":"2013-09-18T06:44:13","slug":"harris-co-woman-alleges-deafness-led-to-firing","status":"publish","type":"post","link":"https:\/\/deafnetwork.com\/wordpress\/blog\/2013\/09\/18\/harris-co-woman-alleges-deafness-led-to-firing\/","title":{"rendered":"Harris Co. woman alleges deafness led to firing"},"content":{"rendered":"<h2>\n\t<strong>Harris Co. woman alleges deafness led to firing<\/strong><br \/>\n<\/h2>\n<p>\n\tAugust 29, 2013&nbsp;\n<\/p>\n<p>\n\tBy JOHN SUAYAN, GALVESTON BUREAU\n<\/p>\n<p>\n\tHOUSTON &ndash; A Harris County woman has brought a lawsuit against Quality Christmas Trees Ltd. for allegedly terminating her because she is deaf.\n<\/p>\n<p>\n\tGabriela Hernandez-Nunez filed the suit against her former employer in the Houston Division of the Southern District of Texas on August&nbsp;22, 2013.\n<\/p>\n<p>\n\tThe defendant, doing business as Houston Garden Centers, employed Hernandez-Nunez as a cashier for 11 years &ldquo;without incident&rdquo; prior to the events in question.\n<\/p>\n<p>\n\tAccording to the suit, in September 2011, the plaintiff received a new manager and was allegedly told she &ldquo;could not keep up with her work because she was deaf.&rdquo;\n<\/p>\n<p>\n\tHernandez-Nunez was fired three months later, the suit states.\n<\/p>\n<p>\n\t&ldquo;The company was aware of the plaintiff&rsquo;s deafness and regarded the plaintiff as having an impairment,&rdquo; the original petition alleges.\n<\/p>\n<p>\n\t&ldquo;Although the plaintiff was qualified to perform her job, the company terminated her employment because of her disability and\/or because the company regarded the plaintiff as disabled.&rdquo;\n<\/p>\n<p>\n\tA jury trial is requested.\n<\/p>\n<p>\n\tAttorney Mark Siurek of Warren &amp; Siurek LLP in Houston is representing the complainant.\n<\/p>\n<p>\n\tCase No. 4:13-CV-2458\n<\/p>\n<p>\n\tThis entry was posted in Civil Rights\/Discrimination, Federal Court, News and tagged Civil rights\/discrimination, Houston Division of the Southern District of Texas, Houston Garden Centers, Mark Siurek, Quality Christmas Trees Ltd., Warren &amp; Siurek L.L.P., wrongful termination.
