{"id":3398,"date":"2008-05-08T12:17:14","date_gmt":"2008-05-08T17:17:14","guid":{"rendered":"http:\/\/deafnetwork.com\/wordpress\/?p=3398"},"modified":"2008-05-13T06:35:08","modified_gmt":"2008-05-13T11:35:08","slug":"legislation-to-make-information-and-communications-technologies-accessible","status":"publish","type":"post","link":"https:\/\/deafnetwork.com\/wordpress\/blog\/2008\/05\/08\/legislation-to-make-information-and-communications-technologies-accessible\/","title":{"rendered":"Legislation to Make Information and Communications Technologies Accessible"},"content":{"rendered":"<p>Legislation Would Make New Information and Communications Technologies<br \/>\nAccessible<\/p>\n<p>Paul Schroeder <\/p>\n<p>On May 1, 2008, the United States Congress heard testimony on draft<br \/>\nlegislation, the &#8220;Twenty-first Century Communications and Video<br \/>\nAccessibility Act.&#8221; The legislation was requested by a coalition of<br \/>\norganizations from the disability community to ensure that new<br \/>\ninformation and communications technologies are accessible. The<br \/>\nhearing took place before the Subcommittee on Telecommunications and<br \/>\nthe Internet. <\/p>\n<p>The legislation that is now under consideration would put in place<br \/>\nnew requirements in several areas. First, it would build on the<br \/>\nexisting law known as Section 255 which requires telephones to be<br \/>\ndesigned so that they are accessible to people with disabilities. That<br \/>\nlaw passed in 1996, and this new legislation would address<br \/>\ncommunications technologies that use the Internet to send and receive<br \/>\ninformation. The legislation would also require video description of<br \/>\nTV programs, starting with a modest requirement, but clearly directing<br \/>\nthat video description be increased over time. Video description means<br \/>\nthe insertion of audio descriptions of a television program&#8217;s key<br \/>\nvisual elements during natural pauses in the program&#8217;s dialogue. Some<br \/>\nmay remember that a previous law had required minimal video<br \/>\ndescription, but that law was struck down in the courts. For those of<br \/>\nus frustrated by the ever-increasing inaccessibility of our TV sets,<br \/>\nthe draft legislation requires that controls like on-screen menus and<br \/>\nelectronic program guides be made to be usable by those of us who<br \/>\ncan&#8217;t see the screen. And, for individuals who are deaf-blind, the<br \/>\nlegislation would enable funds now used to help pay for phone service<br \/>\nfor low-income or hard-to-serve individuals to be used to help pay for<br \/>\nbraille displays and other technology needed to use text<br \/>\ntelecommunications devices and call relay systems. Finally, the<br \/>\nlegislation also includes several improvements for people who are deaf<br \/>\nor hard of hearing. <\/p>\n<p>The hearing featured a wonderful exchange about the accessibility of<br \/>\nnew technologies like the BlackBerry. Sergeant Major Jesse Acosta, one<br \/>\nof our nation&#8217;s military heroes who lost his sight during combat in<br \/>\nIraq, described in blunt terms his frustration with communications<br \/>\ntechnologies that he cannot use. In response, a Congressman<br \/>\ndemonstrated how to use the BlackBerry&#8217;s voice call feature, but Mr.<br \/>\nAcosta pointed out that without being able to see the screen, he<br \/>\ncouldn&#8217;t set up the feature. And, in a priceless exchange, Congressman<br \/>\nEdward Markey, a Democrat from Massachusetts who chairs the<br \/>\nSubcommittee, also pointed out that a blind person would need<br \/>\nassistance from someone who could see to enter names and numbers in<br \/>\nthe contact list.
