NAD and Law Firm File Complaint Against Kentucky State Courts for
\nFailure to Provide Interpreters <\/p>\n
Silver Spring, MD \u2013 The National Association of the Deaf (NAD) and
\nthe law firm Freking & Betz have filed a complaint in federal court
\nagainst the Commonwealth of Kentucky and the Administrative Office of
\nthe Courts alleging their failure to provide qualified sign language
\ninterpreters for Teri Mosier, a deaf attorney admitted to practice in
\nKentucky. The complaint also names as defendants Joseph Lambert in his
\nofficial capacity as Chief Justice of the Supreme Court of Kentucky,
\nand Jason Nemes in his official capacity as Director of the
\nAdministrative Office of the Courts. The complaint was filed in the
\nUnited States District Court in Lexington, Kentucky. <\/p>\n
Defendants\u2019 policy states that they \u201cmust comply with the
\nAmericans with Disabilities Act by providing qualified interpreters
\nfor the deaf and hard of hearing.\u201d However, Defendants\u2019 policy
\nfurther states that they will \u201cnot provide interpreting services for
\nattorneys.\u201d <\/p>\n
The complaint alleges that the Defendants\u2019 refusal to provide
\nqualified sign language interpreter services when Ms. Mosier
\nrepresents clients in court proceedings violates Title II of the
\nAmericans with Disabilities Act and section 504 of the Rehabilitation
\nAct. The failure of the court to provide qualified interpreter
\nservices to ensure effective communication with Ms. Mosier effectively
\nlimits Ms. Mosier\u2019s ability to practice law. <\/p>\n
\u201cState and local courts are required to provide accommodations,
\nsuch as qualified sign language interpreters, when necessary to ensure
\neffective communication with individuals, including attorneys, who are
\ndeaf or hard of hearing,\u201d said Rosaline Crawford, Director of the
\nNAD Law and Advocacy Center.<\/p>\n
The complaint asks the United States District Court to declare that
\nthe Defendants\u2019 policy of not providing qualified sign language
\ninterpreters for deaf attorneys violates the Americans with
\nDisabilities Act and the Rehabilitation Act. The complaint further
\nasks the court to award money damages to Ms. Mosier. <\/p>\n
