Silver Spring, MD – The National Association of the Deaf (NAD) filed
\na complaint on August 14, 2008 with the United States Department of
\nJustice. The complaint alleges that, on two separate occasions,
\nClinical Radiologists, located in Maryland, refused to provide
\nqualified sign language interpreter services to communicate with a
\npatient who is deaf-blind, in violation of Title III of the Americans
\nwith Disabilities Act (ADA) Americans. <\/p>\n
The complaint alleges that the patient relies primarily on tactile
\nsign language to understand what other people are saying. On the first
\noccasion, Clinical Radiologists denied the patient\u2019s request for
\ninterpreter services. He was accompanied to this appointment by his
\nroommate who facilitated the communication. On the second occasion,
\nseveral months later, Clinical Radiologists again denied the
\npatient\u2019s request for interpreter services. This time, the roommate
\ndid not accompany the patient. Clinical Radiologists staff tried
\n\u201cpalm-writing,\u201d tracing letters in the patient\u2019s hand. However,
\nthe patient was not able to understand their tracings in his hand.
\nMedical personnel and other employees also tried writing on paper,
\nwhich was impossible for the deaf-blind patient to read. Due to the
\nlack of interpreter services, the patient did not fully understand the
\ninformation or instructions given to him before, during and after his
\nMRI. <\/p>\n
\u201cHealth care providers are required to provide qualified
\ninterpreter services when necessary to ensure effective communication
\nwith patients who are deaf or hard of hearing,\u201d said Michael Stein,
\nan attorney with the NAD Law and Advocacy Center. <\/p>\n
\u201cHealth care access is critically important to the American deaf
\ncommunity,\u201d said Nancy J. Bloch, NAD Chief Executive Officer.
\n\u201cDeaf and hard of hearing people deserve no less than equal access
\nto the nation\u2019s health care programs and services.\u201d <\/p>\n
The NAD requested that the Department of Justice investigate this
\ncomplaint and order Clinical Radiologists to cease its discriminatory
\npractices. <\/p>\n
