documents show otherwise<\/strong><\/p>\n<p>By Lauren Dodd | Herald staff writer December 4, 2022<\/p>\n<p><strong><em>Note: Killeen, Texas is about one hour away between Waco and Austin, Texas<\/em><\/strong><\/p>\n<p>A deaf Harker Heights High School student had a health emergency on campus Tuesday when her blood sugar reached 400, something her mother warned might happen after her sign language interpreter was abruptly fired.<\/p>\n<p>\u201cThis is totally unacceptable,\u201d Jennifer Evangelista, mother of the Heights High sophomore, said by phone Wednesday. \u201cShe has a number of health issues, including epilepsy, so when my daughter feels stressed, with a lot of anxiety \u2014 that starts to mess around with her sugar levels.\u201d<\/p>\n<p>The stress of being unable to communicate at school, she said, causes her daughter physical health problems.<\/p>\n<p>Without her interpreter, Evangelista said her child has not wanted to go back to school.<\/p>\n<p>\u201cSomething needs to be done, and fast,\u201d she said.<\/p>\n<p>The family is not alone.<\/p>\n<p>Dozens of deaf or hard of hearing students attending the Killeen Independent School District\u2019s Regional Day School Program for the Deaf, in Harker Heights and Killeen, lost their means of communication \u2014 their one-on-one sign language interpreters \u2014 also known as SLIs, before Thanksgiving break.<\/p>\n<p>The district denied responsibility for the termination of the interpreters on Friday; Bryant had worked one-on-one with this particular student for more than three years.<\/p>\n<p>\u201cThey (deaf students) live in a silent world,\u201d Bryant said. \u201cSometimes you\u2019re the only communication they get.\u201d<\/p>\n<p>Bryant grew up with two deaf parents, so as a hearing child, she would frequently interpret for her family.<\/p>\n<p>\u201cIt just hurts,\u201d she said. \u201cI\u2019m sure she feels very, very excluded in several ways. Her voice is gone. Her voice is gone.\u201d<\/p>\n<p>Last week, Bryant said a few Heights High coworkers reached out about her student.<\/p>\n<p>\u201cThe first text I got was, \u2018Where are you? She\u2019s upset. Is there anything I can do?,\u2019\u201d she said, with her voice audibly breaking. \u201cI was like, \u2018I was told I can\u2019t come back after Thanksgiving.\u2019 The response from them was pretty much, \u2018How is this legal?\u2019\u201d<\/p>\n<p>The interpreter said she is concerned about her student\u2019s mental health and her future educational success.<\/p>\n<p>\u201cI feel like special education kids always get stuck at the bottom of the barrel,\u201d she said. \u201cIt\u2019s all terrible. To me, the problem is that the deaf kids are underneath the barrel. They are even more overlooked. On Nov. 18, Killeen ISD terminated more than a dozen sign language interpreters leaving some students without the ability to communicate.\u00a0Lauren Dodd | Herald<\/em><\/strong><\/p><\/blockquote>\n<p>Bryant questioned why the KISD sign language interpreters didn\u2019t get two years to fulfill the certification requirements like teachers do.<\/p>\n<p>As of mid-October, KISD employed more than 200 uncertified teachers on staff. In Texas, uncertified teachers are allowed to have two years to get certified while teaching students, thanks to Texas Education Agency waivers, as long as they can prove they\u2019ve begun their certification process. The same consideration was not given to the district\u2019s interpreters, Bryant and other interpreters said.<\/p>\n<p>\u201cThe Americans with Disabilities Act says \u2018qualified\u2019 not \u2018certified,\u2019\u201d Bryant said. \u201cSo you\u2019re saying 35 years of sign language is not enough qualification? Sixteen years professional experience, and that\u2019s not enough qualification?\u201d<\/p>\n<p>The interpreter emphasized that she is more concerned about the students than she is about her former job.<\/p>\n<p>\u201cEverybody (at Heights High) is pretty much floored with this,\u201d she said. \u201cThose people saw me every day for almost six years. Now, they see my student crying and upset. Lauren Dodd | Herald<\/strong><\/em><\/p><\/blockquote>\n<p><strong>How it started<\/strong><\/p>\n<p>Over the Thanksgiving break and the week afterwards, the Herald received numerous calls from sources, some claiming 500 deaf students were without their interpreters. On Friday, the district responded to the Herald\u2019s Wednesday inquiry clarifying KISD\u2019s deaf program serves 74 deaf or hard-of-hearing students \u2014 not 500 \u2014 26 of whom require one-on-one interpreters at school.<\/p>\n<p>As of Friday, five sign language interpreters remain to service 26 KISD students in need of one-on-one services.<\/p>\n<p>KISD spokeswoman Taina Maya said the district did not terminate their interpreters but rather \u201creminded\u201d their contract companies that the interpreters needed to be \u201ccertified,\u201d causing many to not return after the holiday. Maya said KISD would hire the interpreters back if they become certified.<\/p>\n<p>\u201cKilleen ISD has reminded contractors that all interpreters need to be certified interpreters,\u201d Maya wrote in response to the Herald\u2019s questions. \u201cThus, several contracted interpreters did not return after the district reminded the contractors of their agreement to the district.\u201d<\/p>\n<p><a In the event that they reach out to you, I didn\u2019t want you blind sided by this new requirement. I also don\u2019t expect you to break the news as this will come from their company and KISD.\u201d<\/p>\n<p>The Texas Education Agency\u2019s website states schools that provide interpreter services \u201cmust ensure\u201d interpreters be certified through either the Texas Board of Evaluation of Interpreters (BEI) or the National Registry of Interpreters for the Deaf (RID) tests; however, state and national disability experts say state and federal law only specify the interpreters be \u201cqualified,\u201d which may include certification, or a combination of school and professional experience working with deaf populations.<\/p>\n<p>In Peronto\u2019s Nov. 17 email, she cited reasons for the mass termination not included in KISD\u2019s public statements.<\/p>\n<p>The director said the district was \u201creminded\u201d during a Deaf and Hard of Hearing audit, of \u201cfederal regulations 300.156,\u201d Texas Education Code 21.002, 21.003 and 29.304, that all sign language interpreters need to be certified.<\/p>\n<p>\u201cIn addition, we also learned, through the audit, that KISD is overserving and providing excessive support which can be scaled down in areas,\u201d Peronto\u2019s Nov. 17 email said.<\/p>\n<p>The director said KISD coordinator Malcolm Mahoney was working \u201cwith a company that can provide virtual support, as this seems to be the new and upcoming delivery method.\u201d<\/p>\n<p>\u201cI\u2019m sharing this with you so that you are aware of these forthcoming changes and for your assistance in helping us assign our resources adequately,\u201d her email stated. \u201cWhile we transition, please ask the teachers working with the students needing SLI services to monitor their students academics and to call an ARD (arrival, review and dismissal meeting) if grades or regression is noted. Again, we were cited for having too much SLI support, so hopefully this won\u2019t be an issue.\u201d<\/p>\n<p><a href=\"https:\/\/deafnetwork.com\/wordpress\/wp-content\/uploads\/2022\/12\/Deaf-and-Hard-of-Hearing-Services-Winter-2022_2023-Training-Schedule.pdf\">Deaf and Hard of Hearing Services Winter 2022_2023 Training Schedule (Download PDF format)<\/a><\/p>\n<p>An October review performed by Education Service Center Region 11 consultants, issued &#8216;considerations&#8217; to Killeen ISD regarding its day school program for deaf and hard of hearing students. On Nov. 18, Killeen ISD terminated more than a dozen sign language interpreters due to a lack of state certification. Courtesy | Herald<\/p>\n<p>On Friday, the Herald obtained a copy of the district\u2019s latest \u201cprogram review\u201d dated Oct. 6, titled, \u2018RDSPD (Regional Day School Program for the Deaf) Program Review Continuous Improvement Process Summary of Efforts,\u201d which KISD referred to as the audit.<\/p>\n<p>A review of the 127-page document found \u201cconsiderations\u201d from Education Service Center 11 consultant Anne Darr, and Program Review Facilitator Angela Belding, along with survey results from staff and parents of deaf and hard-of-hearing students, but nowhere in the document did it recommend the district fire the majority of its interpreting staff, without a backup plan, leaving children without the ability to communicate.<\/p>\n<p><strong>\u201cAppalled\u201d reaction<\/strong><\/p>\n<p>When asked for comment last week, the National Association of the Deaf issued a statement on Friday saying it was \u201cappalled\u201d to learn of the situation at Killeen ISD; urging parents of students affected by their interpreters\u2019 removals to contact the organization.<\/p>\n<p>\u201cUnder federal laws such as the Individuals with Disabilities Education Act, the Rehabilitation Act, and the Americans with Disabilities Act, school districts are obligated to provide qualified sign language interpreters to deaf and hard of hearing students who require them in their educational placement,\u201d Howard A. Rosenblum, the association\u2019s CEO said in a statement to the Herald. \u201cWe are concerned that the school district may believe it has found other cheaper options for communication access, but such options are usually ineffective for K-12 education. Lauren Dodd | Herald<\/strong><\/em><\/p><\/blockquote>\n<p>Disability Rights Texas attorney Steven Aleman said the state\u2019s education code does not require interpreters be certified to work in a public school district, but rather the word that is used is \u2018qualified.\u2019<\/p>\n<p>\u201cThe bottom line is that students who are deaf have just as much of a right to public education, and to receive individualized special education services, as any other student with a disability,\u201d Aleman said by phone Friday.<\/p>\n<p>\u201cThe state law I shared with you, Chapter 29.304 is probably the most specific provision on that point in that school districts have a duty to provide qualified personnel in all respects when it comes to meeting the needs of students who are deaf.\u201d<\/p>\n<p>Aleman explained qualified could mean an interpreter was certified, but it wasn\u2019t a requirement by law.<\/p>\n<p>\u201cThe education code provision just uses the word qualified,\u201d he said. \u201cTypically, what we understand that to mean is both by experience, training, licensure, or any combination of elements in their background could make them come into compliance with that Texas Education Code provision.\u201d<\/p>\n<p>The attorney said there isn\u2019t a particular timeline under KISD must find replacement interpreters under state law, but, said it should be done \u201cfairly promptly,\u201d especially if the need for a one-on-one interpreter is listed in the child\u2019s individualized education plan.<\/p>\n<p>\u201cThe school district isn\u2019t entitled to claim, \u2018We can\u2019t find someone\u2019 or \u2018We can\u2019t afford that,\u2019 those are not legal excuses to not meet the needs of a student who is deaf,\u201d he said.<\/p>\n<p>Aleman laid out ways parents can seek recourse for their children at the state and federal levels.<\/p>\n<p>\u201cNeedless to say, it sounds like multiple violations of federal and state law, but the way the system works is the parents have to complain,\u201d he said. \u201cThe parents have to bring legal action against the district. Please know that we are working daily to attract and hire qualified SLIs to serve our KISD students. Of recent, some of our SLIs were relieved from duties due to not meeting the standards of having the required certifications as outlined by state and federal regulations.\u201d<\/p>\n<p>As of Saturday, it is still unclear as to why KISD did not notify parents of the change the day the interpreters were terminated.<\/p>\n<p>Evangelista, the mother of the deaf Harker Heights student, was in tears Friday as she described the day her daughter\u2019s blood sugar reached diabetic coma levels.<\/p>\n<p>\u201cAt 400 she could easily go into a diabetic coma and it could trigger her epilepsy,\u201d Evangelista said, explaining her daughter\u2019s blood sugar can spike when she has high anxiety. Not being able to communicate in school \u2014 be it educationally, socially, or in emergency situations \u2014 is stress-inducing which then triggers a number of her serious health conditions, Evangelista said.<\/p>\n<p>The single mother said her only child is her life, and her education and health is her utmost concern.<\/p>\n<p>\u201cI am her advocate, I am her mother, I am her voice, I will fight to the end for my daughter\u2019s rights,\u201d she said. \u201cThat\u2019s my life, that little girl right there. She\u2019s my everything and I\u2019m not going to allow this to happen to my kid.\u201d<\/p>\n<p>Renecia Harrisruffin, the mother of a third-grade Timber Ridge Elementary School student receiving interpreter services, said she wished the district had given parents and staff more notice.<\/p>\n<p>\u201cI feel like before they let those people go, the district should\u2019ve had a plan in place,\u201d said Harrisruffin, a Copperas Cove educator. She added she will be filing a complaint with the Texas Education Agency.<\/p>\n<p>\u201cThose interpreters had no notice,\u201d she said. \u201cShame on you, KISD. I hope the district is happy that they are failing these students. This is not right.\u201d<\/p>\n<p>As of Friday, Harrisruffin\u2019s daughter is still going to school, but is not receiving deaf educational services.<\/p>\n<p>\u201cWhy wasn\u2019t certification a problem all these other years?,\u201d she said. \u201cCan you imagine how lost these kiddos are feeling right now?\u201d<\/p>\n<p>The Herald reached KISD board president Brett Williams for comment on Friday, at which point he said he did not know anything about the fired interpreters and would need until Saturday to provide a statement.
